Nadine Lustre’s contract with Viva Artists Agency has been upheld as valid by the Quezon City Regional Trial Court, after the actress was sued by the agency for leaving it last year.
As a consequence, the court ordered that Lustre should complete her obligations under her contract and she is not allowed to take projects from other companies without permission from Viva, as per a court resolution cited by Bandera in its report yesterday, June 14.
“Petitioner (Viva) has established its unequivocal right arising from the subject Revised Agency and Management Agreement,” the court stated. “It has established that respondent (Lustre) contracted with them to act as sole and exclusive manager for respondent’s exercise of profession in the show business.”
The court stated that Lustre’s contracts with the agency were executed with her parents at the time that the actress was a minor.
“The contract between the parties is the law between them and Nadine cannot take the law into her own hands and unilaterally terminate her contract with VIVA,” the resolution further stated, as per report.
The agency’s lawyer Atty. Paolo Roxas said that with the ruling, the actress is “precluded from entering into and/or performing contracts involving her services as an artist/endorser, without the consent and participation of Viva.”
He added that issues raised by Lustre related to her agreement with Viva should be subject to arbitrational proceedings, as provided in her contract.
Lustre, who has been with Viva since 2009, was sued by the company last year for supposedly breaching her exclusive contract. Her contract with the agency was supposed to end by 2029.
The actress has been “self-managed” since January 2020 and has since been directly looking after her own affairs, according to her legal counsel Atty. Lorna Kapunan. JB
