Falcis’ camp says they filed motion to defer his arrest

MANILA, Philippines — The camp of Nicko Falcis, who was ordered arrested by a Taguig court, has claimed that they filed an omnibus motion seeking to suspend any warrant of arrest against him.

Falcis’ lawyer, Regi Ponferrada, said in a statement on Friday that they have filed similar motions before the Municipal Trial Court Branch 117 of Taguig City and the Regional Trial Court Branch 70 in the same city.

RTC Branch 70, headed by Acting Presiding Justice Felix Reyes, signed the order asking law enforcement agencies to arrest Falcis.

“We filed an Omnibus Motion before Branch 117 of the Municipal Trial Court of Taguig City, wherein we prayed for leave of court to file a Motion for Preliminary Investigation, for suspension on the ground of existence of a prejudicial question in a civil case,” Ponferrada said.

According to the counsel, the motion also serves to “quash, defer the issuance of, or recall the warrant of arrest on the ground of absence of probable cause.”

“A similar Omnibus motion was filed before Branch 70 of the Regional Trial Court of Taguig City,” he said.

The Office of the City Prosecutor of Taguig earlier dismissed complaints of qualified theft against Falcis, which was filed by his former business partner, television host and actress Kris Aquino.

Falcis was accused of stealing P40 million worth of investments from Aquino. He is facing charges for allegedly violating Section 9 (j) of R.A. 8484 or the Access Device Regulation Act of 2008.

Ponferrada said they will verify if a warrant was indeed issued.

“We will verify if a warrant has been issued, but we hope the issuance of the same will be deferred in light of our motion,” he added. /ee
