TVJ seeks injunction in ‘Eat Bulaga’ copyright case as court sets hearing date

MANILA, Philippines — The Marikina City Regional Trial Court will begin hearing the petition for the issuance of a writ of preliminary injunction filed by the camp of comedic trio Tito and Vic Sotto and Joey de Leon (TVJ) and another plaintiff, Jeny Ferre, against the use of “Eat Bulaga” while the copyright infringement and unfair competition case is pending.

A preliminary injunction is a court order granted at any stage of a proceeding prior to the judgment of the case, requiring a party to refrain from a particular act.

In a two-page document, the Marikina Court ordered all parties to submit the judicial affidavits of their witnesses and copies furnished to the opposing party.

The judicial affidavit must be submitted in court at least three days prior to the first hearing on July 27.

“Any witness whose JA is not filed in court and served on the adverse counsel, within the reglementary period… shall not be allowed to testify whose testimony is deemed accordingly waived,” the court said.

“Dilatory postponements shall never be entertained and allowed,” it added.

The case was filed by TVJ to stop TAPE Inc and GMA Network from using the name, logo, and other devices by the revamped “Eat Bulaga” for allegedly violating copyright infringement and unfair competition. JE
