Kris Aquino’s lawyers assail fiscal’s junking of complaint vs Nicko Falcis

MANILA, Philippines — The decision of the Makati Prosecutor’s Office dismissing Kris Aquino’s qualified theft complaint against her former project manager, Nicko Falcis, is “irregular and legally flawed,” lawyers of the actress said Friday.

In a statement issued by law firm Fortun Narvasa & Salazar, the lawyers maintained that the credit card in question was clearly owned by Aquino’s company – Kris Cojuangco Aquino Productions (KCAP) – and not by Falcis.

“Mr. Falcis’ name was simply put there to show he was authorized to use it for Ms. Aquino, but not for his personal transactions,” the statement said.

Aquino’s lawyers also insisted that Falcis admitted he was wrong in making the alleged purchases and tried paying part of it with his own check.

“His admissions to wrongdoing were all submitted in evidence to the prosecutor who may have glossed over those,” they pointed out.

In a resolution dated February 18, the Makati Prosecutor’s Office dismissed Aquino’s complaints “as there is no sufficient evidence to engender a well-founded belief that Falcis committed the crimes charged.”

“Falcis’ use of the KCAP card for his personal expenditures would not make him liable for theft. He is only liable to BDO for the card transactions that he made using the card,” the resolution stated.

In November 2018, Aquino filed criminal complaints against Falcis for allegedly using funds from her company for personal use.

The complaints of qualified theft were filed separately before the offices of city prosecutors in Makati, Mandaluyong, Pasig, Quezon City, and Manila. /kga
