Archie Alemania indicted for acts of lasciviousness filed by Rita Daniela

Rita Daniela, through her lawyer Maggie Abraham-Garduque, expressed gratitude after the Office of the City Prosecutor in Bacoor City indicted Archie Alemania for acts of lasciviousness in connection with the complaint she filed against him.

As per a resolution dated Feb. 4, 2025, the prosecutor’s office found “prima facie case with reasonable certainty of conviction to indict Alemania.”

“In this case, respondent committed lascivious conduct when he forcibly kissed and mashed complainant’s breast. As correctly pointed out by complainant, lewd design was evident from respondent’s previous actuations prior to the actual incident,” it said.

The prosecutor’s office recommended that the actor be penalized under Article 336 of the Revised Penal Code, which states that “any person who shall commit any act of lasciviousness upon other persons of either sex, under any of the circumstances mentioned on the preceding article, shall be punished by prision correccional.”

After their camp received the copy of the resolution, Abraham-Garduque said Daniela was teary-eyed and “happy that justice is at her side.”

“[Rita] wants to thank all the people who helped and supported her in filing this case,” the legal counsel told INQUIRER.net when sought for comment.

“The process has not became easy for her. She continuously seek for further support and prayers as she raised this legal battle in court,” she added.

Daniela filed acts of lasciviousness complaint against Alemania in October 2024, stating that the actor—with whom she starred in the TV series “Widows’ War”—had sexually violated her by kissing and touching her without consent after a work gathering last September.

Alemania and his camp have yet to release a statement on the matter as of this writing.

What Archie allegedly said, did

In her affidavit, Daniela recalled how her then “Widows’ War” co-star Bea Alonzo hosted a thanksgiving party for the production and cast on Sept. 8, 2024.

Daniela was initially not supposed to go to the party due to her mom being in the hospital, but she later decided to attend as she couldn’t say no to Alonzo.

Coming from an “All Out Sunday” taping, a glammed up Daniela went straight to the venue and arrived there past midnight. After she arrived, she was shocked when a drunk Alemania—whom she treated as an elder brother—supposedly told her, “Naku Rita, ‘wag kang lumapit sa akin. Napaka-f*ck*ble mo tonight ah!”

Daniela felt uncomfortable but since those who heard it just laughed it out, she just tried to dismiss it and thought that the actor was just drunk.

However, Alemania made another lewd remark when Daniela and their fellow actor Royce Cabrera were performing a song.  Alonzo called Alemania out for this as he was apparently already causing a scene. Daniela did not confront him as she thought he did not mean what he said.

Daniela had an encounter with Alemania again when she was waiting for her ride home and the actor offered to give her a ride. Daniela initially refused but he insisted, saying the ride-hailing driver might “rape” her.

The actress eventually agreed to ride with him, thinking he was already sober. However, during their trip, Alemania allegedly started caressing her neck and shoulder. She removed his hand and pretended to be cool despite feeling uncomfortable.

When they arrived at her house, Daniela said Alemania forcefully held her hand as she was about to get out of the vehicle. “Kiss muna!” he allegedly told her.

Daniela then told Alemania, “No Kuya,” and urged him to just go home but the actor allegedly forcibly got hold of her head and kissed her on the lips.

Daniela tried to push him away and was able to open the car door, but Alemania was supposedly able to pull her back. Daniela said the actor groped her by the breast and told her, “Pa-booking naman,” which apparently meant that he wants to have sex with her.

Daniela gathered all her strength and was able to break free and got out of the car. When she was already inside her room, she said Alemania even texted her and still waited outside her residence.

The next day, Alemania texted her again, apologizing for the incident. “Sorry kagabi lasing na kuya mo.”

Just ‘being funny’

Alemania denied the allegations against him, although he admitted uttering the lewd remarks and said he was just “being funny.” He claimed that Daniela even sat beside him to confide after his remarks.

Alemania also stated that during their ride, Daniela was apparently crying over how the actors have been treating her so he caressed her back.

Alemania admitted that he said “Kiss na,” but stressed that he only did so because Daniela was still making small talks when he already needed to head home. He also said that his remark apparently only meant a friendly cheek to cheek to kiss.

The actor then claimed that Daniela was “a bit angry” when she alighted from the car that was why he sent him a message. He also noted that he only apologized to Daniela because of the remarks he said during the party.
