The camp of actress Rita Daniela downplayed her co-star Archie Alemania‘s counter-affidavit, saying it merely affirmed her claims in her complaint for acts of lasciviousness against the actor.
In a statement, Atty. Maggie Abraham-Garduque reacted to Alemania’s filing of his counter affidavit, which was aired on the December 11 broadcast of “Fast Talk with Boy Abunda,” in which the actor allegedly admitted some offensive words, then later on claim that he was “just being wacky.”
“For us, the counter affidavit is a mere affirmation of the complaint-affidavit. Significantly, Mr. Alemania in his counter affidavit admitted that he uttered the words… when he was at the party of Bea Alonzo. He also admitted that while in the car, he touched Rita,” she said.
Garduque claimed that even though Alemania claimed that he was “just being wacky,” it didn’t “erase the fact” that he did the “complained acts” against the actress.
“He said that he uttered those words because he was just being wacky and he made the touches to comfort her, this does not erase the fact that he did the acts complained of,” she said.
“He also said in his counter affidavit that when Rita got out of his vehicle, she was very angry. Why would Rita be angry when he did not do something wrong when they were at the car? If he just touched to comfort her?” Garduqe further said.
Garduque said that the actor’s counter-affidavit is a “material admission,” which means it has probative weight or value that prosecutors may base its resolution.
“These are material admissions by the respondent Alemania himself in his sworn statement which gives reasonable certainty of conviction to indict him for the crime of acts of lasciviousness,” she said.
Rita’s legal counsel was present when Alemania filed his counter-affidavit last December 11, per reports. The actress-singer will submit a reply on December 17.
Rita and Alemania made headlines after the actress-singer filed an act of lasciviousness complaint before the Office of the City Prosecutor in Bacoor last October 30. They worked together in the mystery drama “Widows’ War” which stars Bea Alonzo and Carla Abellana.
