MANILA, Philippines — The Court of Appeals has stood by its June 6, 2018 ordering actress Rosanna Roces to pay P3.1 million in damages to a popular aesthetic clinic for breach of contract.
In a two-page resolution, the appeals court’s former Eleventh Division denied Roces’ (Jennifer Molina in real life) motion for reconsideration to reverse the June 6, 2018 ruling.
The resolution was written by Associate Justice Ramon M. Bato Jr. and concurred in by Associate Justices Ramon Cruz and Pablito Perez.
“A perusal of the motion for reconsideration reveals that there are no new and substantial issues raised therein which have not been judiciously passed upon by this Court. Thus, we find no cogent or compelling reason to alter, modify or reverse said decision,” the appeals court said.
“Accordingly, the instant motion for reconsideration is denied for lack of merit,” it added.
The June 6, 2018 ruling affirmed the findings of the Quezon City Regional Trial Court Branch 220 that the breach of contract complaint filed by Forever Flawless Face and Body Center against the actress has merit.
Roces was previously given shares of Forever Flawless in exchange for promoting, endorsing, marketing and advertising services.
Fulfilling her part of the agreement, the actress endorsed the clinic’s services, including treatments by well-known celebrity doctor Victoria “Vicki” Belo, a consultant and also the president and chairman of Belo Medical Group Inc.
In 2003, Roces decided to sell her shares in the company, which Forever Flawless agreed to buy for P1.5 million. Part of the agreement was for Roces not to malign or discredit the company, its services, products and its stockholders and officers or she would have to pay P1 million for each infraction.
The aesthetic clinic filed the complaint against the actress after she appeared in television shows issuing alleged malicious statements against the clinic. /ee
